  • Is CourtHouse Concepts able to fulfill background checks during Covid-19 and are there any delays in turnaround times?

Our combined investment in technology and our extensive network built over the years enables us to continue fulfilling background screenings in over 99% of US jurisdictions despite some ongoing court closures. Now more than ever, getting people back to work is critical. At CHC, we are “all hands on deck” to get new employees onboarded with timely, high-quality screenings that gets them back into the workforce quickly and safely.

  • Are drug testing facilities still open and are there any delays in drug screening?

CHC continues to offer drug and health screening services through our key partners LabCorp and  Quest. We are working diligently with our partners to maintain the continuity of our drug and health services. We are also monitoring changes closely and taking measures to keep our teams informed of any material changes to services.

  • Can I require my employees to be screened for COVID-19 prior to returning to work? Is that discriminatory or illegal?

The EEOC has already stated that COVID-19 viral tests are permissible under the ADA.

While it is a best practice for employers to pay for COVID-19 “return to work” testing, there is no clear prohibition in place as of April 30, 2020, against passing this cost to employees or candidates. However, EEOC guidance does not negate current employment laws in place at the state level. Therefore, it’s critical to check your state laws to determine if you are legally able to pass the cost of COVID-19 testing on to your applicants or employees, as some states prohibit employers from passing the costs of a drug screen or background check to an employee or candidate.

  • What happens if a check completes on a candidate, and they are hired, and then they inform us they have COVID-19?

According to CDC guidance, employers may either delay the start date or withdraw a job offer when an applicant displays symptoms or tests positive for COVID-19.
